On February 14, 2023, the National Commission for Regulatory Improvement published the draft submitted by the Energy Regulatory Commission (“CRE”) of the proposed General administrative provisions regarding Electromobility for the integration of charging infrastructure for Electric Vehicles and Plug-In Hybrid Electric Vehicles, to the National Electric System, as part of a Smart Grid.
The proposed general administrative provisions (“DACGs”) aim to regulate the orderly and safe connection of charging infrastructure for electric vehicles (“EVs”) and plug-in hybrid electric vehicles (“PHEVs”), to the SEN and the development of a digital platform intended to track the evolution of charging infrastructure in Mexico. If approved and enacted, the general purpose of the proposed DACGs would be achieved through the following specific objectives:
Based on information provided by the CRE, the implementation of the proposed DACGs is expected to (i) provide certainty to end users and power suppliers regarding the requirements that shall be met in connection with power supply service requests related to charging infrastructure; (ii) reduce the risks of accidents or failures through the participation of qualified personnel, the use of certified equipment, verification reports and certifications, providing certainty to end users about the safety and durability of the charging infrastructure installed in their properties; and (iii) allow the general public to access information on the location of charging points, including information on the type of chargers and connectors available in each charging point and the prices offered.
Among may other new requirements, the proposed DACGs provide that end users wishing to install EVs and PHEVs charging infrastructure within a property already receiving low voltage or medium voltage basic power supply services, shall request a new power supply contract independent from the one they already have.
The proposed DACGs shall be applicable to all power supply service requests and all connection applications submitted after the enactment of these provisions.
